Glossary of Drunk Driving (DUI) Terms

Bodily Alcohol Content (BAC): If you are over the age of 21, you are not allowed to drive with BAC of over .08 or greater. The level drops to .02 or greater for anyone who is under the age of 21.

CDL (Commercial Driver License): License used for driving commercial vehicles and trucks.

Driving Under the Influence (DUI): A term used to describe a wide range of drunk driving charges.

Implied Consent Law: Michigan law requires all drivers to submit to a BAC test if pulled over. If a person refuses, they could face points on their license or have their license suspended.

Operating with the Presence of Drugs (OWPD): A charge given to individuals who were found to have overused prescribed medication, cocaine or other Schedule 1 controlled substances while driving.

Operating Under the Influence of Liquor (OUIL): A felony charge given after two or more prior alcohol-related driving convictions have been given within a seven-year period of time.

Operating While Intoxicated (OWI): A first offense where your BAC tested above .17. The charge is also known as a High BAC offense.

Operating While Visibly Impaired (OWVI): A charge where a law enforcement agent believes your driving was influenced by the consumption of alcoholic substances, controlled substances or a combination of alcoholic liquor and a controlled substance. You do not actually need to have a high BAC to receive an OWVI charge.

Zero Tolerance: Michigan’s standards that do not allow anyone under the age of 21 to get away with driving with any level of alcohol in his or her system.
