Michigan Gun Laws: Restrictions on Licenses

There are restrictions on who can apply for a handgun permit. If you meet one of the following criteria, you will not be able to obtain one:

You are a convicted of a Michigan felony or have pending felony charges.
You have been convicted of certain misdemeanors in Michigan within three years or specific domestic violence crimes in the last eight years.
Dishonorably discharged from the armed services.
Have been ruled mentally ill or legally incapacitated

If you were not able to obtain a permit and are found carrying a firearm illegally, the punishment can be severe.

Individuals who legally obtain permits still have restrictions on where the weapon can be carried. If you have a license to carry a concealed weapon you must abide by the restrictions placed on the license. You can also be charged with a crime if you carry a weapon to any of these restricted locations.

Schools or school property – exception if you transport the weapon in your vehicle when dropping or picking up a child from school.
Sports arena or stadium
Hospital
Church, synagogue, mosque or temple
Tavern where the main sale is of alcohol sold by the glass.
Public or private day care facility
Entertainment venue which holds 2,500 people more

Anyone with a license who carries in these restricted areas could face a misdemeanor charge punishable by up to 90 days in jail and up to $100 in fines.

Punishment if Convicted of Carrying a Concealed Weapon without a License

If you are found carrying a concealed weapon in a vehicle or on your person without a license to carry under Michigan law, then you can be charged with a felony. The only places you can legally have a gun without a license are in your place of dwelling, your place of business or on other land you own.

The conviction for carrying a firearm without a permit charge comes with the following penalties:

Up to 5 years in prison
Fines of up to $2,500.00

In addition, to carrying a firearm without a permit you could also face charges if you have possession of outlawed weapons. You will be charged with a felony if you have any of the following weapons in your possession. You are also prohibited from manufacturing or selling these weapons in Michigan.

Short-barreled shotguns
Bombs
Metal knuckles or billy clubs
Machine guns
A device used to emit gasses with the intention to harm someone (self-defense sprays do not fall under this provision)

Convictions related to these weapons come with the same penalties as other illegal possession and are punishable in the following ways:

Up to 5 years in prison
Fines of up to $2,500.00
