Alimony/spousal Support

Even though Michigan has No Fault Divorces, there are still instances where spousal support, otherwise known as alimony, is awarded to one party. The court may require either party in a divorce to pay support in order to allow the other spouse to maintain the standards of living he or she held prior to the breakup. There are different types of alimony which exist in Michigan.

Some awards are fixed amounts while others are modified at specific intervals. As your Michigan divorce lawyer, our team at Grewal Law PLLC will fight for an equitable judgment in your case.

Child Support

During your divorce, the child support payments you will be required to pay will be calculated and collected by the Friend of the Court in Michigan. The calculations of payments for child support are determined using the Michigan Child Support Formula.

The mandatory formula considers the income of the parent who will be paying along with the support provided by the other parent. Some of the expenses considered include how many minor children are involved in the case, the income of each parent, any alimony being paid along with the payment of support for any other children.

Our child support attorneys are ready to help you get the support you deserve. We will also fight to get an equitable payment plan for you if you are the one paying the support.

Child Custody & Visitation

There are a lot of different custody and visitation arrangements a judge can issue in your case. As your legal counsel, we will help you understand the array of custody arrangements which exist in Michigan. The Child Custody Act outlines joint physical and legal custody options along with sole physical and legal custody options.

Other types of custody which exist here include primary physical custody and other forms of visitation as determined for individual cases. Grewal Law will explain your custody arrangements to you and how they could impact your family.

Parenting Time

Parenting time schedules are set up by the court and are designed to find a balance for your child to have a relationship with both parents. The court will typically go along with an arrangement parents reach outside of court. However, if an agreement cannot be reached a judge will determine how parenting time is allocated.

Under Michigan law, a non-custodial parent is still able to receive parenting time. Although in some instances a parent may be awarded supervised parenting time. The only time where one party does not have the right to parenting time is when there is evidence the child’s mental, physical or emotional health will be in jeopardy.

If you are facing decisions regarding parenting time with your children contact us at Grewal Law today.

Property Division

Under Michigan law, you are allowed to keep assets you acquired prior to your marriage even if your spouse is trying to claim rights to it. Additionally, property inherited by one spouse, even during the course of the marriage, is considered personal property. In contrast, the property acquired during a marriage is equitably divided under state law.

During your divorce proceedings, the court will ask each party to disclose how a piece of property was obtained to help determine how property is divided. Hire an experienced divorce attorney to handle property division negotiations in your case.

Investment/retirement Funds Division

Our attorneys are also ready to help in the division of your monetary investments. The types of investments and retirement funds considered by the court include, but are not limited to the following items:

  • Retirement accounts including 403(b)s 401(k)s
  • Pensions
  • Stocks, bonds and investment accounts
  • IRAs including traditional accounts and Roth IRAs

The Michigan attorneys at Grewal Law PLLC will work with financial experts to ensure your investments are protected. We will also help you understand what will be considered marital property and divided by the court.

Prenuptial & Postnuptial Agreement

Before getting married you can have a prenuptial agreement drafted. The agreement is designed to protect the assets an individual brings into a marriage. We are ready to help you draft and implement a prenuptial agreement (prenup) designed to fit the needs of your family. In addition, some married couples may find it necessary to protect assets they have obtained during a marriage.

A postnuptial agreement (postnups) is designed to protect these assets, however, they are not always recognized under Michigan law. Your family lawyer will work to draft an agreement designed to protect your individual assets in a possible divorce.

Paternity

The process of determining the father of a child when the parents are not married is known as establishing paternity. If someone is married when a child is born, the husband is presumed to be the father of the child. However, there are circumstances where the paternity of a child may be questioned during the course of a divorce.

The process to establish paternity can be done without entering the court system through the filing of certain documents after simple genetic testing is completed. When dealing with issues surrounding paternity it is important to seek the legal counsel of a Michigan family law lawyer before signing any paperwork.

How to Prepare Before Filing for Divorce

When you are contemplating a divorce, there are lots of things you should do to prepare for a possible filing. From gathering paperwork to documenting your assets, the preparation you complete prior to filing will help your divorce proceed more smoothly. Our family law attorneys will guide you throughout the process and will prepare you before you formally file for divorce.

Divorce Mediation & Trials

There are different options for how your divorce case proceeds through the court system. An alternative to appearing in court for your divorce is using mediation. The process of mediation allows you and the other party to have open communication with the help of a neutral third party who is a trained mediator.

If mediation is not possible your case will need to proceed through the Circuit Court in your area to go to trial. Once your paperwork is filed, as the individual filing for divorce, you will be known as the plaintiff while your spouse will be the defendant in the Family Court division.

As your attorneys, the team at Grewal Law PLLC will help you understand the entire divorce trial process and will be with you along the way.
