Sexual Assault Survivors Can Pursue Civil Lawsuits

In the United States, one in three women and one in six men experience some form of contact sexual violence in their lifetime. Unfortunately, rape and sexual assault is the most under-reported crime in the United States; as an estimated 63% of sexual assaults are not reported to police. Why Pursue Civil Lawsuits?

The first reason survivors of sexual assault should pursue civil lawsuits: it could give them personal justice. In criminal court cases, perpetrators are not held accountable to their victims, but to the criminal justice system. The single goal of the criminal justice system is to determine if the accused is guilty of the crime he or she is charged with and to hold him or her accountable for breaking the law.

However, the goal of a civil lawsuit is to provide justice and compensation for the survivor.

In civil lawsuits, survivors can hold their attackers and those who enabled them personally accountable for the harm they’ve caused. Therefore, civil lawsuits give survivors the chance to be heard and vindicated on a personal level. However, justice isn’t the only thing survivors receive in successful civil lawsuits.

Personal Compensation

The second reason survivors of sexual assault should consider pursuing civil lawsuits: it could give them personal compensation for their injuries. Nothing can repair the damage of a sexual assault, but compensation from a successful civil lawsuit can help survivors pay for counseling and other post-traumatic needs.
