Michigan’s Legal Requirements for a Radiology Error Claim
Michigan law imposes specific procedural rules on medical malpractice cases, and missing a single deadline can end a valid claim before it begins. These requirements apply to each case.
- Two-Year Statute of Limitations: Under MCL 600.5805(8), most claims must be filed within two years of the act or omission that caused the injury.
- Six-Month Discovery Rule: Under MCL 600.5838a(2), if the harm wasn’t and couldn’t reasonably have been discovered within two years, a patient has six months from the date of discovery to file.
- Six-Year Statute of Repose: Michigan sets an absolute outer deadline of six years from the date of the alleged act, with narrow exceptions for claims involving young children who hadn’t yet reached certain ages when the malpractice occurred.
- 182-Day Notice of Intent: Before a complaint can be filed, MCL 600.2912b requires written notice to be served on every provider named in the suit at least 182 days in advance.
- Affidavit of Merit: Under MCL 600.2912d, the complaint must be accompanied by an affidavit signed by a qualified medical professional who practices in the same specialty as the defendant.
- Non-Economic Damages Cap: Michigan limits non-economic damages in medical malpractice cases under MCL 600.1483. The cap adjusts annually for inflation, and a higher tier applies to certain permanent or catastrophic injuries.
